PLEASE READ THOROUGHLY!

Guests have agreed to rent a private property (condo or home) for good and valuable consideration. In consideration, Guest hereby covenants and agrees to the following:

DEPOSITS: A valid credit card number and/or deposit is/are required for all reservations. Visa, MasterCard, Discover or American Express cards are accepted. There is a $50-200 (property dependent) non-refundable processing fee due at time of booking with the deposit. The security deposit for homes will be returned to your credit card after all bills are received, usually within 15 to 20 days after departure. Your security deposit and/or credit card will be charged for any damage, missing items, loss, excessive cleaning or any unpaid rent resulting from your stay, including damage or excessive cleaning required to condo association amenities such as pools, tennis courts, spas, barbecues, etc. Any interest earned on security deposits will be retained by The Parrish Collection Kauai.

RENT: Full rental payment is due 60 days prior to arrival for condos and 90 days prior to arrival for homes. Rent must be paid in US funds by cash, check, money order or credit card. The balance due will be charged to your credit card automatically unless advised otherwise. If your payment is not received by the due date, your reservation will be subject to cancellation.

CANCELLATIONS: You have the right to cancel with 60 days written notice for condos and 90 days written notice for homes. With timely cancellation notice, all advance funds will be returned less a cancellation fee and the applicable processing fee within 24-48 hours (or more, depending on the credit card used). Cancellation fees are $50 for condos; $100 to $500 for homes (property dependent). During the holiday seasons, the cancellation fee will be from $200 to $500 (property dependent). Bookings made within the cancellation period are non-refundable. Some promotions require full payment and are non-refundable.

If written notice is received less than 60 days for condos or 90 days for homes, all advance funds will be forfeited unless we can re-book your rental dates. No refunds will be given for early departure, as you are responsible for the entire time booked once within the non-cancellation period. Due to the fact that our properties are individually owned, we reserve the right to relocate you in an unforeseen circumstance such as the sale of the unit, a maintenance concern or owner usage, and if necessary, cancel your reservation with 30 days notice.

TRAVEL INSURANCE: You have been advised to secure travel insurance to protect you against any cancellations that may occur.

MINIMUM STAY REQUIREMENTS: Typically, there is a 7 night minimum stay for homes and a 5 night minimum stay for condos. During the holiday period, there is a 14 night minimum stay for all home bookings and a 7 night minimum stay for all condos. Some condos may have shorter stay requirements available.

CHECK-IN TIME: 2:00 PM for condos, 4:00 PM for homes.

CHECK-OUT TIME: 10:00 AM. Late checkout is available at an additional charge of 50% of the daily rate + tax up to 6:00 PM. After 6:00 PM a full day charge will apply.

ACCOMMODATIONS: The information while deemed reliable is not guaranteed. Properties offered for rental are individually and privately owned and reflect the tastes of each owner. Distances to the beach are approximate. Every effort has been made to assure accurate descriptions. Changes in inventory or items and/or decor occur from time to time and such changes will not void or alter the terms of the rental agreement. The Parrish Collection Kauai will not be held responsible for noise or loss of view due to construction or for any amenities which are closed down for maintenance purposes or inoperable conditions. Guests must abide by house rules as provided.

SECURITY OF THE HOME AND RENTAL EQUIPMENT: When you rent a property, you assume full responsibility for it and its contents, as well as your personal property. Always lock the doors and windows when you leave. Lock your automobiles and put away any rental equipment. Any use of rented equipment by the Guests is strictly at your own risk, liability and could cause you to incur additional expenses.

OCCUPANCY: The number of guests is restricted to the number described. Additional guests must be disclosed and approved. Weddings, receptions, parties or functions are not permitted on the property unless otherwise approved ahead of time. Any use of the home for other than strictly family vacation purposes or any non-permitted occupants may result in the termination of this contract and eviction from the premises.

TELEPHONE: All properties are equipped with private telephones for your convenience and safety. All properties have long distance blocks which cannot be removed and require a calling card for long distance calls. Abusing this privilege by charging or receiving collect calls will jeopardize your security deposit. The cost of these calls, plus $15 per bill collection fee, will apply.

CLEANING: Your property will be expertly cleaned prior to your arrival, and again after your departure. For most properties the standard fee is charged to the guest. Excessive departure cleaning, if necessary, will be deducted from your security deposit or charged to your credit card. Additional housekeeping services (towel service, light or complete housekeeping services) are available upon request for an additional fee.

MAINTENANCE AND REPAIRS: We make every effort to ensure that all equipment within each rental is in working order. In the event of a breakdown, we will strive to repair it as soon as possible after being notified of a problem. We cannot guarantee that spas, air conditioners, televisions, appliances, high speed access, etc. will not break down during your stay and therefore, no refunds or adjustments will be made for mechanical failure. Furthermore, there will be no refunds or adjustments made for any other unexpected situation beyond our control such as bugs, rodents, roosters, frogs, weather and the like.

LOCK-OUT/LOST KEY POLICY: In the event a guest is locked out of the property during the rental period, the guest may borrow a key by coming to the office. After business hours, guests must call 634.8544 for assistance and an agent will meet the guest at the office. There will be a $50 charge for this service, and this is due at the time service is rendered. If payment is not made at the time of service the guest credit card on file will be charged accordingly. There is a $50 charge for a lost property key or pool key.

MISCELLANEOUS POLICIES, CONDITIONS & WAIVERS:

  • All rates subject to Hawaii State Taxes of GET (General Excise Tax) of 4.16% & TAT (Hotel Tax) of 9.25%.
  • Guest is not renting the Property for a public purpose that involves admission of the public.
  • All properties are designated non-smoking by Hawaii State law and do not allow pets. Violation of this will result in a detoxification charge equal to one night’s rent.
  • Rates and amenities are subject to change without notice.
  • Upon departure, follow specific instruction on your “arrival letter” for key return. There will be a $50 fee charged to your credit card for each key not returned to the proper location.
  • High speed Internet service may be available at select properties, however The Parrish Collection Kauai is not responsible for service provider connectivity, technical support, or equipment failure.
  • Open fires are prohibited on the property at all times.
  • Guest hereby acknowledges that the ocean is inherently dangerous and use can result in serious injury or death.
  • Guest acknowledges that swimming pools and/or spas are potentially dangerous if improperly used, particularly with regard to children, who may not appreciate the potential risks involved.
  • Guest acknowledges that lanais and lanai railings are potentially dangerous if improperly used, particularly with regard to children, who may not appreciate the potential risks involved.
  • Guest acknowledges that the Property may be equipped with one or more bicycles for the Guests’ use. Guest acknowledges that riding a bicycle is a potentially dangerous activity if improperly done or done by inexperienced persons.
  • While Kauai is a safe place, please lock all doors and windows when not in residence and we highly suggest that all windows and doors remained closed and locked whenever possible.

GUEST HEREBY WAIVES AND RELEASES ANY CLAIMS AGAINST OWNER, OWNER’S RENTAL AGENT, SUCCESSORS, ASSIGNS, EMPLOYEES OR REPRESENTATIVES, OFFICIALLY OR OTHERWISE, FOR ANY INJURIES OR DEATH THAT MAY BE SUSTAINED BY GUEST ON OR NEAR OR ADJACENT TO THE PROPERTY, INCLUDING THE FACILITIES. GUEST AGREES TO USE THE FACILITIES ENTIRELY AT THE GUEST’S OWN INITIATIVE, RISK, AND RESPONSIBILITY.

Guest acknowledges and agrees that Guest will be responsible for and will assume the risk for any of Guest’s minor family members, guests, or invitees that use the Facilities. Guest hereby agrees to supervise any children, non-swimmers, individuals with physical or mental defects, and all others using the Facilities and to take full responsibility for their supervision.

Guest agrees to defend, indemnify and hold harmless the Owner, Owner’s rental agents, successors, assigns, employees or representatives, officially or otherwise, for any damages, costs, expenses, attorney’s fees, incurred by Owner, Owner’s rental agents, successors, assigns, employees or representatives due to any claims relating to injuries or death that may be sustained by Guests on or near or adjacent to the resort property during the rental term.

This legal instrument may be pleaded as a complete defense to any action or other proceeding, which may be brought, instituted or taken by the undersigned, the undersigned’s family, other Guest invitees or Property users, in breach of this instrument. If any provision of this release is declared in valid or unenforceable, the remaining portions of the release shall not be affected thereby and shall be fully enforced.

This Agreement shall be binding upon the heirs, personal representatives, executors, administrators, successors and assigns of the undersigned.
